…or so says Woody Allen.

For the most part, I think it’s true…but more on that in a moment. First, today’s workout.

Just Showing Up

My little brother - who recently passed the Bar, was sworn in, and has begun practicing law - took his first ‘criminal’ client. This individual (we’ll call him/her ‘Chuck’, though, to be totally honest, I don’t even know if ‘Chuck’ is a man or a woman) was stopped and ticketed for doing 120mph in a 55. Ooops.

Chuck was absolutely certain he was going to lose his license. He looked around for an attorney to help him. They all wanted $1500 or so. Lucky for him, he came upon my brother who is new (wants to get his name out) and hungry (willing to take less than $1500).

So, little brother (’LB’) shows up to court on traffic day, stands in line, and, eventually, sits down with the prosecuting attorney (’PA’).

PA: There’s no reason for you to be here. We don’t negotiate anything for more than 20mph over the posted speed limit.

LB: Oh. OK. Let’s go out there to the judge and set a court date.

PA: What?

LB: Let’s go talk to the judge and set a court date. I filed my motion for discovery 12 days ago. Let’s just get it done.

PA: But…uh…just plead guilty. We don’t do negotiations.

LB: I heard you. We won’t negotiate. Let’s go set a court date. ~starts to get up~

PA: Wait a minute. ~looks down at stack of cases~ We’re not going to court…what do you want?

LB: ~still standing~ Well…hmmm…some fine, probably. And Chuck keeps his license.

PA: Keeps his license…~hesitates~…OK. What about the fine?

LB: $100

PA: $100!

LB: Yeah.

PA: Hmmm…$100 and a 1-day driving class.

LB: OK.

~everybody moves out to the court room~

PA: (to judge) Chuck is going to plead guilty, and we’ve agreed to no loss of license, $100 fine, and a 1-day driving class.

Judge: ~looks at PA, looks at LB, looks at PA again, looks at Chuck~

Judge: (to Chuck) You know he just got you a great deal, right?

Chuck: Uh…really? I mean…yeah! uhhh…yes, sir.

Judge: OK…

And so it was. What started out as a ‘definite’ loss of license for a year and a ‘no-negotiation’ policy, became a $100 fine and no loss of license. That’s what happens when you just show up. It doesn’t always work out that way, but it certainly won’t work out that way if you don’t bother trying.

Anyway, well done, little brother.
